DOJ Investigator 3 - Trial Division (Salem)

Are you an experienced investigator with a background in locating witnesses, evidence, records, and preparing investigative reports? The Oregon Department of Justice, Trial Division, is seeking an Investigator 3, and this may be the position for you! In this role you will conduct investigations assigned to you by the Chief Trial Counsel and Assistant Attorney Generals within the division. These investigations will include litigation in state and federal courts, representing the State of Oregon (agencies, officers, employees, etc.), and Oregon Tort Claims.

The Trial Division defends the State of Oregon and all its agencies, departments, boards, commissions, and before the state and federal trial courts in Oregon. The Trial Division's responsibilities range from defending claims for money damages to asserting policy positions that are of vital importance to the state. Investigators work as part of a trial team led by the assigned Assistant Attorney General who assigns tasks to legal secretaries, paralegals, and investigators who work collaboratively to defend civil cases.

This position offers a hybrid schedule which requires a minimum of 1 day in-office and up to 4 days remote work. Additional in-office days may be required during training. Hybrid schedule subject to change at management discretion.

Job Duties

  • Identify, locate, and interview witnesses, take and record statements by notes, electronic recording, or transcript.
  • Prepare investigative reports.
  • Identify, locate, and interview persons / experts who possess special, technical, or scientific knowledge related to cases.
  • Serve subpoenas.
  • Analyze and evaluate statements of parties, witnesses and others associated with the case. Participate in depositions and prepare legally sufficient documents such as subpoenas and affidavits.
  • Identify, locate, and preserve physical, documentary evidence. Prepare evidence and other exhibits for use at trial. Take or obtain admissible photographs, film or video tape of relevant scenes, items of persons.
  • Assist staff attorney during preparation and trial of case, with potential for trial testimony.
  • Be available for night, weekend, and holiday assignments, when required.

Required Experience

  • Four years of recent (within last ten years) full-time investigative experience which included conducting fact finding; collecting and preserving evidence according to the rules of evidence; examining records; locating and interviewing witnesses to verify or disprove claims of suspected law violations; and writing investigation reports sufficient for use at administrative hearings or in court. Examples of qualifying investigation experience are in areas such as law enforcement investigation, insurance investigation, investigative trial support, or financial fraud investigation.
  • College-level courses in Law Enforcement, Criminal Justice, Law, Accounting, or Auditing may be substituted on a year-for-year basis for up to one year of the required experience.

    Work experience is based on a 40-hour work week. (Example : 20 hours a week for one year would equal six months of work experience.)

  • Must have and maintain a valid Oregon Driver's License.
  • Must have the ability to travel out of town, at times including evenings or weekends.

  • Experience in conducting field investigations and surveillance.
  • Experience using investigation tools, the internet, and computer software to prepare reports and exhibits.
  • Excellent organizational skills and attention to detail.
  • Demonstrated skill in critical thinking.
  • Excellent communication skills and experience interviewing witnesses in a community setting from various social and economic backgrounds.
  • Experience working with confidential information and privileged communications.
  • Experience in the collection, organization, and analysis of large volumes of information from multiple sources.
  • Demonstrated ability to work independently and prioritize own work.
  • Experience testifying in a courtroom setting.
  • Ability to apply de-escalation techniques when dealing with difficult and challenging individuals.
